The petitioner has preferred this application for grant of regular bail in a case registered under sections 392 of the Indian Penal Code.

As per the prosecution case, a sum of Rs. 49 lacs was looted from the informant and a substantial portion of the same was recovered from the Scorpio vehicle wherein the petitioner was also one of the occupants.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 26.8.2021 (Annexure-1) passed in Cr. Misc. no. 14103 of 2021. Subsequent thereto co-accused Amit Kumar

Patna High Court CR. MISC. No.70462 of 2021(2) dt.22-12-2021 2/2 Sharma has been enlarged on bail vide order dated 27.10.2021 passed in Cr. Misc. no. 60561 of 2021 and co-accused Amit Kumar Rai has been enlarged on bail vide order dated 2.12.2021 passed in Cr. Misc. no. 18495 of 2021. The petitioner has remained in custody since 26.8.2020 and there is no chance of the trial concluding in the near future.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for over 1 year 3 months and grant of bail to the above mentioned two co-accused, the petitioner is directed to be enlarged on bail in connection with Sessions Trial no. 213 of 2020 (arising out of Pratapganj P.S. Case no. 114 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge VII, Supaul.
