JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302/201/120(B)/34 of the Indian Penal Code.
The allegation is that on 10.12.2013 co-accused Mukesh Sharma and his wife called the son of the informant at their place on mobile for settlement of some dispute and they with the help of other co-accused committed his murder and threw the dead body in a field at village- Lataraha.
On behalf of the petitioner, it has been submitted that the petitioner has got no criminal antecedent. The name of the petitioner has come in course of investigation. There is no eye witness to the occurrence nor there any direct or indirect evidence
Patna High Court Cr.Misc. No.25717 of 2015 (3) dt.23-09-2015 2/2 against the petitioner. It is further submitted that other co-accused, namely, Mahendra Sharma, has been granted anticipatory bail vide order dated 23.07.2015 in Cr. Misc. No. 21336 of 2015. On behalf of the State, it is submitted that the petitioner is not named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Supaul in connection with Supaul P.S.Case No. 591 of 2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
