JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-08-2021 Heard learned counsel for the petitioner, learned counsel appearing for the opposite party no.2 and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Complaint Case No. 2007C of 2018, registered under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner and the opposite party no.2, jointly, submit that the petitioner has already been allowed provisional pre-arrest bail by this Court vide order dated 04.09.2019 and thereafter, the matter was referred to the Patna High Court Mediation and Reconciliation Centre for

No.56233 of 2019(5) dt.26-08-2021 2/3 settlement of dispute in between the petitioner and the opposite party no. 2, who are husband and wife, vide order dated 20.11.2019 but the matter could not be settled up till now due to non-functioning of the Court in physical mode due to Pandemic of Covid-19. They, further, submit that it would be better to dispose of this case with a direction to the trial court to refer the matter before the District Mediation Center, Araria, for settlement of dispute in between the petitioner and the opposite party no.2, as both parties are ready to settle their dispute. Accordingly, this application is disposed of with a direction to the trial court to send the matter before the District Mediation Center, Araria, for settlement of dispute in between both parties within six months.

If the dispute in between the petitioner and the opposite party no. 2 is settled before the District Mediation Center, Araria, the learned court below shall confirm the provisional bail of the petitioner. If the dispute is not settled due to laches of the petitioner, the trial court will be at liberty to cancel the bail bond of the petitioner furnished in the light of order dated 04.09.2019 passed by this Court allowing the provisional bail of the petitioner.
