The petitioner apprehends his arrest in a case under Sections 419, 420 of the Indian Penal Code and Sections 3/10 of the Bihar Examination Control Act.

One Ansh Kumar was apprehended while he was appearing at the examination in place of Abhay Kumar having Roll Code 82067, Roll No. 1500698. It was the petitioner, who set up Ansh Kumar to appear at the examination in order to fetch good marks.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Nawada P.S. Case No. 165/2015. Accordingly, the same is rejected. The petitioner, if so advised, may surrender in the court below within and make prayer for regular bail. The court

Patna High Court Cr.Misc. No.25661 of 2015 (2) dt.16-07-2015 2/2 below shall consider the prayer for regular bail of the petitioner without being prejudiced from this order and taking into consideration that co-accused Ansh Kumar has already been enlarged on regular bail.
