ABHISHEK REDDY ORAL ORDER 22-01-2025 Without going into the merits or demerits of the case, having regard to the fact that the authorities in their counteraffidavit have admitted that the petitioner's application for closure of the agreement and payment of the amount is under consideration and to that effect necessary letters have been written to the Executive Engineer, Rural Works Department, Work Division, Darbhanga and the Executive Engineer in written has sent a proposal to the Superintending Engineer,

Patna High Court CWJC No.14289 of 2024(4) dt.22-01-2025 2/2 Rural Works Department, Work Circle, Darbhanga for closure of the agreement in question vide letter no. 2660 dated 19.11.2024, the present writ petition is disposed of directing the authorities to take necessary action as per the recommendations made by the Executive Engineer vide letter dated 19.11.2024 and also the letter of the Superintending Engineer, Rural Works Department, Work Circle, Darbhanga dated 19.11.2024 bearing no. 1808 as expeditiously as possible preferably within a period of eight weeks from the date of receipt of a copy of this order. The authority shall take necessary steps for refunding the performance security as well as additional performance security amounting to Rs. 30,05,000/- and if any, bills are pending before the authority pertaining to the maintenance.

2. With the above direction, the present writ petition stands disposed of.
