Opposite Party/s ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 20-02-2015 The two petitioners, who are co-villagers of the informant, apprehend arrest in Raniganj Police Station (PS) Case No 176 of 2003 instituted under Sections 452, 376 of Indian Penal Code.
Learned counsel for the petitioners submits that the case has been lodged falsely to implicate the petitioners because of subsisting land dispute between the parties. He further draws attention of this Court to show that police, after due investigation and supervision, filed final form not sending up the petitioners for trial but the learned Magistrate disagreed and took cognizance of offences as alleged. Learned counsel points out that being covillagers, no one would do such a heinous crime in such a manner as alleged much less after entering the house tying the parents and then merrily walking away.
Patna High Court Cr.Misc. No.35230 of 2014 (2) dt.20-02-2015 Having considered the matter as well as the fact that the case has been supervised by higher police officers who all found that it is a case of false implication, in the event of their arrest or surrender within four weeks from today, the petitioners abovenamed shall be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Raniganj PS Case No 176 of 2003 (GR No 1253 of 2003) subject to all conditions as laid down in Section 438
(2) of Criminal Procedure Code.
