The petitioners are languishing in custody since 15.02.2015 in a case registered for the offences punishable under sections 387 of the Indian Penal Code.
The accusation is of demand of extortion though letters enclosed five envelops written by Mukesh Chaudhary, Anil Chaudhary, Rajiv Chaudhary and Shyam Rai. The name of the petitioner sprang up in the confession of co-accused Lal Babu Paswan.
It is submitted by learned counsel for the petitioner that only on suspicion the petitioner has been roped in the present case. Nothing substantial transpired, during investigation, against
Patna High Court Cr.Misc. No.26193 of 2015 (2) dt.24-07-2015 2/2 petitioner. Moreover, the investigation has already concluded. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid fact, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Hathauri P.S. Case No.06 of 2015.
