2. The petitioner apprehends his arrest in connection with Chhaurandano (Mahuwa) P.S. Case No. 415/2023 registered for offences under Sections 302, 201, 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner along with other co-accused are accused of killing the husband of the informant.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has not committed any offence. During investigation, it has come that the deceased had died because of having consumed liquor and the petitioner and others

5. Learned APP for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for anticipatory bail is allowed.

7. Accordingly, let the petitioner, above-named, in the event of his arrest or surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Raxaul at Motihari/concerned court below in connection with Chhauradano (Mahuawa) P.S. Case No. 415 of 2023 subject to the conditions as laid down under Section 438 of the Code of Criminal Procedure.
