JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioner is apprehending his arrest in a case instituted under Section 498A, 448, 323, 325 and 504 of the Indian Penal Code and Section 3 / 4 of D.P.Act.
Heard learned counsel for the petitioner and the State. The accusation against the petitioner is of assaulting and torturing the daughter of the informant (Opp. Party no.2) for non fulfillment of dowry.
It has been submitted on behalf of the petitioner that he is ready to keep his wife with full dignity and honour but the same is not acceptable to his wife. It is also submitted that the petitioner is ready to deposit an amount of Rs. 1500/- every month in the court below, which shall be released in favour of opposite

On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, the above named petitioner is directed to deposit an amount of Rs. 1500/- (fifteen hundred) every month in the court below, which shall be released in favour of opposite party no.2.
Let in the event of his arrest or surrender in the court below within a period of four weeks, the above named petitioner shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.R. Santosh Kumar, Judicial Magistrate, 1st Class, Munger in connection with Kashim Bazar P.S.Case No. 120/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
