The petitioner seeks bail in Gaya P.S. Case No. 366/2016 registered under Sections 279 and 304 of the Indian Penal Code.

The allegation against the petitioner is that the petitioner being the driver of the auto-rickshaw handed over the auto-rickshaw to his friend to drive. While the friend of the petitioner was driving the auto-rickshaw, the auto-rickshaw met with an accident. The auto-rickshaw turned turtle and the daughter of the sister of the informant came under the auto-rickshaw and died. It is submitted that the petitioner was not driving the autorickshaw. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond
