JUSTICE PURNENDU SINGH ORAL ORDER 03-01-2023 The writ petitioner was forced to file the present writ application for removing the encroachment from the public road recorded as plot no. 5626 and 5627 adjacent to the southern boundary of the petitioner just in front of Kaluahi Circle Office, Madhubani.

Today, it has been informed by Mr. Arif Daula Siddiqui, AC to SC-25 that in compliance of order dated 24.11.2022, the Encroachment Case No. 06 of 2022 was initiated and an opportunity was given to respondent no. 6 to show cause as to why the encroachment from the land in

Patna High Court CWJC No.20784 of 2021(4) dt.03-01-2023 2/2 question should not be removed in absence of any valid legal document produced by respondent no. 6. The encroachment was finally removed from the land in question on 14.12.2022. In compliance of the order, the respondent has brought on record the order dated 24.11.2022 informing this Court that the encroachment has already been removed. Counter affidavit is accepted.

In above view of the facts and circumstances, the present writ petition is consigned.
