JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 324, 325, 307, 504 and 506/34 of the Indian Penal Code.
It is alleged by the informant that petitioner Balmukund Yadav has abused the informant and has pointed pistol on informant. It is further alleged that petitioner no.2 Ajay Yadav has followed the direction given by the petitioner no.1 Balmukund Yadav. The petitioner no.2 Ajay Yadav has also participated in the said occurrence along with petitioner no.1 Balmukund Yadav. It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. The police has submitted a final form against the petitioners vide
Patna High Court Cr.Misc. No.27822 of 2015 (4) dt.28-09-2015 Annexure-2. Subsequently, the court below has deferred with the said final form and taking cognizance. It has further been submitted that the matter has been settled between the parties outside the Court and a compromise petition has also been filed in the court below.
On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Sheikhpura in connection with Sheikhpura P.S.Case No.326 of 2010, G.R.No.974 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
