Petitioner is apprehending his arrest in a case under section 7 of the EC Act on the allegation that he being a PDS dealer indulged in selling the PDS rice in the black market. Petitioner states that the rice in question does not belong to him and he has falsely been named by the driver of the pick up van carrying rice.
In the facts and circumstances of the case, in the event of arrest and surrender, let petitioner Binod Prasad Roy be released on bail on furnishing bail bond of Rs.3,000/-, with two sureties of the like amount, one of the sureties would be in form of cash deposit to the satisfaction of the Chief Judicial Magistrate, Darbhanga in Darbhanga Sadar (Sonki) Police Station Case No. 165 of 2013.
