JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 12-01-2016 Prayer of the petitioner for re-totaling in English had already been accepted and acted upon by the respondent-Bihar Sanskrit Shiksha Board. Based on the marks recorded in the tabulation register, re-totaling was done and the marks have been found to be correct.

In addition to that the petitioner was also directed to appear before this Court to enable the Court to test whether he has even the basics of knowledge of English or not if he was serious about the marks which he expects and what has been awarded to him, he has chosen to be discreet about it by not appearing and accepting the offer of the Court in this regard. In view of the same, it is evident that petitioner is only fishing for marks over and above his actual

Counsel's submission that he should be given average marking is not based on any evidence or material. Writ application is dismissed.
