The petitioner is apprehending his arrest in connection with Majhauliay P.S.Case No.157 of 2019 registered for offences punishable under Sections 413, 414, 34 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. Police intercepted one motorcycle during the vehicle checking and one person and the petitioner succeeded in fleeing away and from the another person loaded country-made pistol and other articles were recovered, who disclosed the name of the petitioner.

Submission of the learned counsel for the petitioner is that except the confessional statement of the co-accused there is nothing against the petitioner as well as he has no criminal

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the learned court below to verify the criminal antecedent of the petitioner and if he has no criminal antecedent, he shall be released on bail in connection with Majhauliya P.S.Case No.157 of 2019 dated 9.4.2019 to his own satisfaction. It is also made clear that if for verification some time is required to the learned court below, he shall release the petitioner till then on provisional bail.

With the aforesaid direction, this application is disposed of.
