Case No.560 of 2013 instituted under Section 379/34 Indian Penal Code and Section 135 of the Electricity Act.

None appears on behalf of the petitioner.

Counsel for the NBPDCL is present. He has submitted that police has submitted charge-sheet in the case and cognizance has already been taken.

A report was called for from the Court below with regard to present stage of the case, which has been received, from which it appears that cognizance has already been taken on

Patna High Court Cr.Misc. No.36648 of 2015 (5) dt.26-06-2018 2/2 04.09.2015 for the offence under Section(s) 379 Indian Penal Code and Section 135 of the Electricity Act after submission of charge-sheet.

In view of such, the investigation has been completed and after submission of charge-sheet cognizance has been taken against the accused.

This application is, accordingly, dismissed.

The Court below will proceed with the case in accordance with law.
