The petitioner is accused in connection with Guraru P.S. Case No. 209 of 2018, registered under Section 302/34 of the Indian Penal Code.

The accusation is that marriage of sister of informant, Mukesh Prasad Singh, was performed in the year 2008 with Rajiv Singh (petitioner) but his sister was being tortured for petty demands. Later on, dispute arose regarding partition in between, Rajiv Singh, husband of the sister and his brother, in which, his sister become fade up. Due to quarreling of sister-in-law of his sister in respect to family matter, in the evening of 16.11.2018, Pintu Singh, brother-in-law of his sister gave order to kill his sister, on which, Niraj Devi and Ujala Kumari, sister-in-law and niece of his sister, caught hold her heir and

Patna High Court CR. MISC. No.56708 of 2019(3) dt.11-12-2019 2/2 laid down on the ground. At that time, her husband also caused injury to his sister.

Learned counsel for the petitioner submits that admittedly, petitioner is the husband of the deceased, sister of the informant, in fact, for watching TV programme, scuffle took place in between the deceased, wife of the petitioner and her niece Ujala Kumari, in which, deceased, wife of the petitioner, fell down and sustained injury, but with ulterior motive, the present case has been lodged with false allegation giving colour of murder of the deceased. Further submission is that petitioner, who is husband of the deceased, is in custody since 15.06.2019 and after investigation, police submitted the charge sheet against the petitioner. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Gaya, in connection with Guraru P.S. Case No. 209 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
