2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 498A, 341, 323, 379, 504, 34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.
3. The matter was earlier referred to the Patna High Court Mediation and Conciliation Center for amicable settlement of the dispute between the parties.
4. A report of the Mediation Center is available on record which would go to show that the parties have reached an agreement dated 28.01.2025 whereby an amount of Rs. 2,50,000/- has been paid by the petitioner to the opposite party no. 2 on 28.01.2025, in cash, which has been accepted as an
Patna High Court CR. MISC. No.68708 of 2024(4) dt.15-04-2025 2/2 amount for one time settlement between the parties. They have also agreed upon other terms and conditions.
5. Today, learned counsel for the opposite party no. 2 has not appeared but I have heard learned counsel for the State.
6. Taking into facts and circumstances and the factum of settlement having been reached between the parties vide memo of agreement dated 28.01.2025 in the Reconciliation Proceeding No. 1939 of 2024 in the present case, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Hilsa P.S. Case No. 428 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
