2. The petitioner has preferred this application for grant of regular bail in connection with Rampur P.S. Case No. 198 of 2024 dated 05.05.2024 registered for the offences punishable u/ss 356, 379, 413, 414 read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, on secret information, three unknown miscreants were making preparation to commit crime, upon such information, the informant along with his other associates reached there. On seeing the police party, three unknown miscreants started to flee away after leaving their motorcycle but they were apprehended and disclosed their name

Patna High Court CR. MISC. No.62925 of 2024(2) dt.24-09-2024 2/3 as Arayan Kumar, Chandan Kumar and Shahid Kumar. They also disclosed that a few days ago, they snatched a mobile which he had sent to the co-accused, Rohit Kumar.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner has no concern with the alleged recovery rather the mobile phone has been recovered from the house of the co-accused, Rohit Kumar. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 06.05.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the petitioner was found involved in recovery of a stolen motorcycle with the other co-accused.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Gaya in connection with Rampur P.S. Case No. 198
