The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 323, 376, 504/34 of the Indian Penal Code and Section 4,8 of POCSO Act.

The prosecution case in nutshell is that petitioner used to blackmail the victim and also used to send vulgar photos to her. It is further alleged that petitioner ravished the victim

It is also submitted that victim and petitioner were in relationship for sometime last to the extent of assurance of marriage. Moreover, the Petitioner is in judicial custody since 11.08.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned APP appearing on behalf of the State and learned learned counsel for the informant have vehemently opposed the prayer of the petitioner and submitted that victim has specifically whispered against the petitioner, in her statement recorded under Section 164 of Cr.P.C. She has stated that on the pretext of marriage the petitioner has committed rape with her. Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.
