JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in a case instituted under Sections 406, 420, 462, 468, 471 and 120(B) of the Indian Penal Code.
It is alleged by the informant that accused Girja Devi by presenting herself as Mahadev promised to pay the double amount within a month got deposited money from public. Accused Chandan Loiri, Soni Devi, Udai Singh, Ram Chandra Singh, Uchchal Singh and others to visit the village and by giving allurement took money from public.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It has also been submitted that the main allegation has been made against one
Patna High Court Cr.Misc. No.28017 of 2015 (3) dt.29-09-2015 Girja Devi who is said to have taken the money from the innocent people. There is no specific allegation against the petitioner. Other co-accused has been granted anticipatory bail by this Court vide Cr.Misc.Nos. 12531 of 2015, 13598 of 2015 and 16193 of 2015. On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of her arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri A.Mishra, Judicial Magistrate, Ist Class, Purnea in connection with Dhamdaha P.S.Case No.128 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
