The petitioner is languishing in custody in a case registered for the offences punishable under Sections 8(c), 21(b), 25, 29 of the N.D.P.S Act. There is recovery of 35 grams of Ganja from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner has no concern with the recovered seized contraband. The

Patna High Court CR. MISC. No.58950 of 2022(2) dt.04-02-2023 2/2 recovered seized contraband is 35 grams which comes under the purview of small quantity as per N.D.P.S Act. The petitioner is in custody since 20.08.2022. In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, N.D.P.S Act, Gaya in connection with Delha P.S. Case No. 271 of 2022.
