The petitioner seeks bail in connection with Session Trial No. 685 of 2015, arising out of Samastipur (Mufassil) P. S. Case No. 258 of 2015 registered under Sections 302/34 and 120-B of the Indian Penal Code as well as Section 27 of the Arms Act.
The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 30.01.2016 passed in Cr. Misc. No. 52392 of 2015.
It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 26.08.2015 and
Patna High Court Cr.Misc. No.4185 of 2017 (2) dt.15-02-2017 2/2 till date only five charge-sheet witnesses have been examined, out of whom four have not stated anything about the involvement of the petitioner.
Be that as it may, regard being had to the reasons assigned in my previous order dated 30.01.2016 for rejecting the application for bail of the petitioner as also the fact that the trial is at advance stage, I am not inclined to take a different view of the mater. Accordingly, the application for bail is rejected once again.
The court below is directed to conclude the trial expeditiously as early as possible, preferably within nine months from the date of receipt/production of a copy of this order.
