Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. The F.I.R. of the occurrence of dacoity is against unknown.
Submission is that the name of the petitioner surfaced in the confessional statement of co-accused in some other case. Petitioner is in custody since 25.03.2019. He was never put on Test Identification Parade, nor any incriminating article was recovered from his possession. Investigation of the case is already complete.
Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of
Patna High Court CR. MISC. No.55760 of 2019(2) dt.06-09-2019 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Paroo Police Station Case No.02 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
