The petitioner, by way of the present writ petition, has prayed for issuance of directions upon the respondents to modify/ enhance the first A.C.P. pay scale as well as the second A.C.P. pay scale of the deceased-husband of the petitioner herein, in view of the fact that similarly situated clerks of the department have been granted higher pay scale upon grant of benefits of the first and second A.C.Ps. 2.

The learned counsel for the respondents has submitted that while reviewing the matter, it came to light that similarly situated persons have wrongly been granted higher pay scale, hence their cases

Patna High Court CWJC No.20655 of 2010 dt.30-07-2018 2/2 have been taken up and necessary modification has been done as also recovery has been directed to be effected to the extent, excess amount has been paid to them.

In view of the aforesaid, if so advised, the petitioner may file a representation for redressal of his grievances before the concerned authority, however, at the moment, no relief can be granted to the petitioner since no other ground has been urged by the petitioner.
