This is a petition for grant of regular bail for offences under Sections 395 and 412 of the Indian Penal Code. The offence alleged is commission of dacoity by unknown criminals. Name of the petitioner has transpired in the confessional statement of the co-accused. The petitioner is in custody since 08.11.2016.

Submission of the petitioner is that the petitioner has not been put on test identification parade nor anything has been recovered from the possession of this petitioner. The learned counsel for the informant opposed the prayer for bail.

It appears that similarly situated co-accused, Suraj Kumar, has already been granted regular bail by a coordinate Bench of this Court of this Court in 49523 of 2016. Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Rajgir P.S. Case No. 137 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, IV, Nalanda at Biharsharif, or successor Court. (Birendra Kumar, J) SA/- U √ T √
