The petitioner seeks bail in connection with Muffasil P.S. Case No. 191 of 2021 instituted for the offences under Sections 30(a)(d) and 41 of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 01.09.2021, is a person with clean antecedent, is a women aged about 55 years and charge-sheet has been submitted in the case.

Learned counsel for the petitioner submits that the allegation is of recovery of two litres of liquor from the house of the petitioner and sixteen litres liquor from a field near the house of the petitioner apart from recovery of liquor from other accused persons.

No.71012 of 2021(2) dt.28-02-2022 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, all recoveries were made from a field near the house of the petitioner and she has been falsely implicated alleging that two litres liquor was recovered from her house.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 01.09.2021, is a person with clean antecedent, chargesheet has been submitted in the case and is a woman, let the petitioner above named be released on bail on furnishing bail bond of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Spl.
