JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2015 Learned counsel for the petitioner is permitted to make necessary correction in the petition, as prayed for. Heard learned counsels for the petitioner and the State. The petitioner being husband of the victim is languishing in custody since 20.12.2013 in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

It is alleged that the daughter of the informant was killed after about seven years of marriage for non-fulfillment of dowry demand of motorcycle and Rupees fifty thousand. It is submitted by the learned counsel for the petitioner that during trial the informant, father of the victim and brother of the victim have not supported the accusation and the victim was

Patna High Court Cr.Misc. No.36245 of 2014 (4) dt.16-02-2015 mother of three children and admittedly, the marriage was performed more than seven years prior to the occurrence. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge IV, Siwan in connection with S.T. No. 250 of 2014 arising out of Hussainganj P.S. Case No. 284 of 2013. The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on two consecutive occasions.
