The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 26.02.2016 passed in Cr. Misc. No. 56192 of 2015, on the ground that the petitioner is in custody since 20.09.2015 and prosecution story appears not probable and reliable and as such the petitioner deserves sympathetic consideration as the medical evidence also does not support the prosecution version.
Learned APP opposes the prayer of bail by submitting that the victim girl in her statement recorded under Section 164 Cr.P.C. supported the allegation of rape and further all the witnesses have supported the prosecution version. In the facts and circumstances stated above, finding no
Patna High Court Cr.Misc. No.8931 of 2017 (2) dt.01-03-2017 good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected. However, let the trial be expedited and concluded as early as possible, preferably within six months from the date of receipt/production of a copy of this order after taking the same on priority basis.
