JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2017 This is an application for grant of bail for offences punishable under Sections 366A/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that as per prosecution case there is allegation of kidnapping of the victim and committing rape upon her but no such occurrence has taken place. As a matter of fact, there was love affair between the petitioner and the victim and the dispute was settled outside the court. Petitioner is in custody for six months. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, I am not inclined to grant bail to the petitioner, the same is rejected.

However, the court below, i.e., C.J.M., Begusarai, is

Patna High Court Cr.Misc. No.5512 of 2017 (4) dt.03-04-2017 2/2 directed for commitment as well as conclusion of the trial of Muffasil P.S. case no. 93 of 2016 and petitioner will be at liberty to renew his prayer for bail once informant and the victim are examined by the court concerned.
