JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner is languishing in custody for the offences punishable under Sections 376, 406 and 409 of the Indian Penal Code.
Allegation is that the petitioner defalcated money of Indira Awas Yojna which was allotted to the sister of the informant. Further allegation is of sexual exploitation of the sister of the informant by the petitioner.
Submission of the petitioner is that in fact money had gone into the bank account of Rekha Devi, sister of the informant and present false has been lodged just to pressurize because Rekha Devi was pregnant since eight months.
Patna High Court Cr.Misc. No.2704 of 2017 (3) dt.29-03-2017 Considering the entire facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai/Successor Court, in connection with Teghra P.S. Case No.296 of 2014, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
