2. The petitioners have filed the present writ

2/4 application for direction to the respondent authorities to consider the case of the petitioners for their posting in accordance with merit-cum-choice basis as Headmaster at their respective place in any three districts for which choice has been given and to post them accordingly.

3. Learned counsel for the petitioners submit that the petitioners were selected as head master. Dispute is with regard to posting of the petitioners as per merit-cum-choice. The identical matter has been decided by a Co-ordinate Bench of this Court in CWJC No. 11252 of 2025 dated 30.08.2025 and in paragraph 46 of the aforesaid judgment, the Hon'ble Court has taken note of the fact that out of 35334 Head Teachers, 32,672 were allocated districts as per their choice and only 2662 successful candidates were allocated districts through randomization. Similar is the case of Head Masters. The Court directed the committee which has been assigned the work to allocate the preferential district to invite their objections and deal with them manually after acknowledging their home district and their reason for posting in nearby district(s). Additional Chief Secretary, Education Department, Government of Bihar has been directed to convene a meeting with the Director Secondary Education as well as the Director, Primary

3/4 Education to frame a model for redressal of grievance of allocation of nearby district after inviting objection, preferably within a period of four weeks from the date of receipt/production of a copy of this order.

4. Learned counsel further submits that petitioners had given their choice for district as Patna, Gaya and Munger Division. None of the choices given by the petitioners has been considered and the petitioners have been posted on the basis of randomization at Purnia and Araria.

Learned counsel for the State submits that the petitioners may be directed to file representation before the committee headed by Additional Chief Secretary Education Department, Government of Bihar, Patna as per the order of this Court passed in CWJC No. 11252 of 2025 and the committee will consider the grievances of the petitioners manually as per the direction of this Court.

Considering the aforesaid submissions made by the parties and the nature of prayer made in this writ application and also considering the fact that in similar matter, this court has directed the committee headed by Additional Chief Secretary, Education Department, Government of Bihar, Patna to decide the grievance of the teachers manually, this writ application is

4/4 disposed with liberty to the petitioners to file a representation before the committee headed by Additional Chief Secretary, Education Department, Government of Bihar, Patna within a period of two weeks and if such representation is filed, the Additional Chief Secretary, Education Department, Government of Bihar, Patna shall dispose the same in the light of judgment given by this Court in CWJC No. 11252 of 2025 at the earliest.

7. According the present writ application is disposed of.
