JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-08-2015 Perused the report of Superintendent of Police, Bhojpur dated 19.08.2015 which suggests that only the charge-sheet witness Dr. Naresh Prasad is left to be examined. The petitioner being husband of the victim has renewed his prayer for bail in a case registered for the offences punishable under Sections 304(B), 120B/34 of the Indian Penal Code.

The petitioner is languishing in custody since 10.06.2013.

The accusation is of killing the sister of the informant by administering poison after two years of marriage for non-fulfilment of dowry demand. The F.S.L report reflects the cause of death as poisoning.

Considering the fact that only one chargesheet witness Dr. Naresh Prasad is left to be examined, this

It is expected from the Trial Court to expedite the trial and make all effort to conclude the trial. It is also expected from the Superintendent of Police, Bhojpur to monitor the trial and try to get the only charge-sheet witness examined on the next date fixed, if he has already not been examined. Accordingly the application is disposed of in connection with Sikharratta P.S. Case No. 32 of 2013, pending in the Court of learned Chief Judicial Magistrate, Bhojpur, Ara.
