The petitioner is accused in connection with Kotwali P.S. Case No. 307 of 2016, registered under Sections 17, 18, 21 and 22 of the Indian Penal Code, pending in the court of Sessions Judge, Gaya. The accusation is of recovery of 60 puriya of Heroin in white paper of 09 gram from the possession of the petitioner. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he is in custody since 11.09.2016. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail.
