The petitioners apprehend their arrest in a case under Section 304B, 201/34 of the Indian Penal Code. The informant, brother of the deceased, alleged that his sister was married to Narayan Prasad Gupta in the year 2009. The informant further alleged that all the accused persons were tortured his sister and killed her.

It is submitted that no specific allegation is made against the petitioners. The petitioners are brother-in-law and sister-in-law of the deceased. Similarly situated accused, Sunita Devi, Sanni Kumar, Mantu Kumar and Deepa Devi have already been enlarged on anticipatory bail vide orders passed in Cr. Misc.

Patna High Court Cr.Misc. No.28588 of 2015 (3) dt.12-10-2015 2/2 Nos. 33059 of 2015 and 23987 of 2015.

Considering the facts aforesaid and the fact that the petitioners are brother-in-law and sister-in-law of the deceased and the marriage was solemnized in the year 2009, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.Q.H. Rizvi, learned Judicial Magistrate, 1st class, Gaya in Tekari P.S. Case No. 81 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
