2. The petitioner seeks bail in a case instituted for the offences under Sections 366A of the Indian Penal Code and Section 8 of the POCSO Act.

3. Allegation against the petitioner is that he took away the daughter of the informant to somewhere with intention to marry.

4. It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.04.2023 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been

Patna High Court CR. MISC. No.63400 of 2023(2) dt.10-10-2023 2/2 submitted in the present case. The petitioner has falsely been implicated in the present case. The victim has been recovered. Her statement has been recorded under Section 164 CrPC, in which she has denied the allegation of her abduction. She had left the house out of her own will and got married to the petitioner.

5. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

6. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned court below/court concerned in connection with Bounsi P.S. Case No. 97 of 2023.
