This is a petition for grant of anticipatory bail for offence under Sections 147, 148, 149, 341, 323, 324, 307, 379, 354B, 504, 506, 447 and 448 of the Indian Penal Code. Allegation is that the accused person, including the petitioners, assaulted the informant and his mother by means of khanti, due to which they received injuries. The wife of the informant came to save, she was also assaulted by the accused person.
Submission of the petitioners is that similarly situated accused person have already been allowed anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 54157 of 2016 on 20.12.2016.
Considering the aforesaid fact, the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with
Patna High Court Cr.Misc. No.3019 of 2017 (2) dt.10-02-2017 2/2 Wazirganj P.S. Case No. 130 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, I, Gaya, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
