The petitioner seeks pre-arrest bail in connection with Ara (M) (Dhhobhan O.P.) P.S. Case No. 125 of 2019 for the offences alleged under Sections 323, 447, 448, 504, 506 and 34 of the Indian Penal Code and 27 of the Arms Act. The accusation is that petitioner, along with two unknown, came at the door of the informant, boarding on a Pulsar motorcycle and entered in the house and started to abuse and cause assault to the informant, Azeem Raja. When he made protest and raised alarm, then, villagers reached there and petitioner fled away making firing, threatening and leaving the motorcycle at the door of the informant. Learned counsel appearing on behalf of the petitioner submits that in fact due to misunderstanding the present case was lodged. Later on, the informant filed the compromise petition in the Court below, which is also detailed in the order, dated 31.07.2019, passed in A.B.P. No. 1485 of 2019 whereby the petitioner was refused anticipatory bail. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Ara (M) (Dhhobhan O.P.) P.S. Case No. 125 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
