JUSTICE BIRENDRA KUMAR ORAL ORDER 20-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 272/273 of the Indian Penal Code and Sections 47(a)(f)(g)/48/49/50 of the Bihar Excise (Amendment) Act, 2016.
Thirteen liters of country-made liquor was recovered from the possession of the petitioner. Submission is that petitioner is in custody since 12.09.2016 and has stated on oath that he has got no criminal antecedent.
Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.2703 of 2017 (2) dt.20-02-2017 2/2 Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. Kavindra, learned Judicial Magistrate, 1st Class, Dehri, Rohtas/Successor Court, in connection with Nauhatta P.S.
