Learned counsel for the petitioners undertake to remove the defects, as pointed out by the office within three weeks on resumption of physical mode, failing which the office is directed to place the matter before the Bench. The petitioners apprehend their in case registered for the offence punishable under Sections 341, 323, 504, 354, 379 and section 34 of the Indian Penal Code.
Prosecution case is that the petitioners and other accused persons are said to have assaulted the informant and also
Patna High Court CR. MISC. No.70547 of 2021(2) dt.13-06-2022 2/3 snatched Rs. 10,000/- and golden chain from the pocket of the informant. Ruby Devi was abused and molested by them. Learned counsel for the petitioners submits that the petitioners are quite innocent and have not committed any offence in the manner alleged and have falsely been implicated in this case.
There is general and omnibus allegation against the petitioners though the petitioners are also accused in one case. Learned APP for the State opposed the prayer for bail petition.
Considering the above facts and circumstances, the petitioners, above-named, in the event of their arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Barh, in connection with Bakhtiyarpur P.S. Case No. 175 of 2020, subject to the condition as laid down under Section 438(2) Cr.P.C. The petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates, without reasonable cause, their bail bonds are liable to be cancelled.
