JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2015 The petitioner being husband of the victim is languishing in custody since 06.06.2014 in a case registered for the offences punishable under Sections 364, 498(A) of the I.P.C.

It is alleged that sister of the informant was married with the petitioner in the year 1997. Subsequently the relationship went soured when learned Court below directed the petitioner to make payment of maintenance of Rs. 7000/- per month and Rs. 1500/- as litigation cost. The victim went traceless since June, 2013.

It is submitted by learned counsel for the petitioner that though the victim went traceless in June, 2013 but she has made bank transaction in July, 2013. Considering the fact that the petitioner being husband of the victim has not lodged any case, this Court is

Patna High Court Cr.Misc. No.35911 of 2014 (3) dt.02-02-2015 2/2 not inclined to grant bail to the petitioner at present. Accordingly the application is dismissed in connection with Kazi Mohammadpur P.S. Case No. 237 of 2013, pending in the Court of learned Additional Chief Judicial Magistrate, Muzaffarpur.
