In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 328 and 302 of the I.P.C The prosecution story, in brief, is that one Mridula Devi W/O Rajeev Kumar has alleged that on 20.6.2014 the petitioner and his wife both assaulted to her husband due to that blood came from ear and for that report was instituted in the police station. Thereafter both petitioner and his wife given poison thereafter he found in unconscious condition. The victim was brought to P.M.C.H by her father-in-law and local person but in the way he died.
Patna High Court Cr.Misc. No.28816 of 2015 (2) dt.24-07-2015 2/2 It is submitted on behalf of the petitioner that the petitioner and the deceased are own brother. The deceased was not keeping well and it was the petitioner who had taken the deceased to the hospital for treatment but subsequently he died. Taking advantage of the same due to property dispute the petitioner has been falsely implicated in the present case. It has further been submitted that the petitioner has got no criminal antecedent and other co-accused have been granted bail vide Annexure-3 to the present application.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. Sri Sushant Ranjan, J.M.1st Class, Patna in Patliputra P.S. Case No. 236 of 2014, subject to the conditions as laid down in section 438
(2) of the Cr.P.C.
