JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-02-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Saraiya P.S. Case No. 70 of 2014, registered under Sections 498(A), 304(B) and 34 of the Indian Penal Code. The accusation is of torturing of the sister of the informant by her husband and other in-laws due to nonfulfillment of demand of dowry and lastly causing death of her sister (deceased) by pressing her neck.

Learned counsel for the petitioners submits that petitioners are father-in-law and mother-in-law of the deceased, sister of the informant. Further submission is that, in fact, incidentally deceased sustained injury through edge of the bed

Patna High Court Cr.Misc. No.2476 of 2017 (2) dt.07-02-2017 2/2 and she died before reaching hospital due to internal injury at her head. Further submission is that while the allegation is of causing death of deceased by pressing of her neck, but the Postmortem report reveled that only one abrasion 2"X1" found on the forehead. Further submission is that petitioners have no criminal antecedent are in custody since 28.08.2016 and 28.07.2016, respectively.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the 3rd Addl. Sessions Judge, Muzaffarpur in connection with Saraiya P.S. Case No.70 of 2014. (Rajendra Kumar Mishra, J) manish/- U T
