The petitioner seeks bail in connection with Paharpur P.S. Case No.148 of 2016 registered under Sections 376 and 379 of the Indian Penal Code.

The accusation of the informant is that after the death of her husband, the petitioner used to reside in her house and make physical relation with her on the pretext of performing the marriage with her. On 10.07.2016, the petitioner left the house by taking away the ornaments worth of Rs.50,000/- and also performed his marriage.

Learned counsel appearing on behalf of the petitioner submits that, admittedly, the informant is widow having three

No.1740 of 2017 (2) dt.19-01-2017 2/2 children but with an ulterior motive and to put undue pressure upon the petitioner to perform the marriage with her, the informant has lodged this false case, while the petitioner is married and is leading his conjugal life. The petitioner having no criminal antecedent is in custody since 30.09.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, in connection with Paharpur P.S.
