The Petitioner seeks bail in N.D.P.S. Case No. 04 of 2016, arising out of Barauni(Chakiya O.P) P.S. Case No. 177 of 2016 instituted for the offence under Section(s) 20/22 of the Narcotic Drugs & Psychotropic Substances Act. It has been submitted on behalf of the petitioner that as per seizure list, the ganja has been recovered from the house of Chandan Yadav. The seizure list bears the signature of wife of Chandan Yadav. The petitioner is in custody since 11.11.2016. The petitioner was not present at the place of seizure. The petitioner has gone to Orissa to appear in the examination of Railway Recruitment Board.

Patna High Court Cr.Misc. No.5402 of 2017 (7) dt.02-05-2017 2/2 As per written report, 10 Kg of ganja has been recovered from the joint house of Chandan Yadav and petitioner Vijay Yadav. It is also mentioned in the written report that both the accused managed to run away. The seizure list which has been enclosed with the F.I.R clearly mentions that ganja has been recovered from the house of Chandan Yadav and seizure list bears the signature of Sharda Devi, wife of Chandan Yadav. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, N.D.P.S. Act, Begusarai in connection with N.D.P.S. Case No. 04 of 2016, arising out of Barauni (Chakiya O.P.) P.S. Case No. 177 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
