The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 324, 326, 307, 504, 34 of the Indian Penal Code.

The prosecution case as per F.I.R is that all the F.I.R named accused persons including the petitioner surrounded the husband of the informant. It is alleged that co-accused Ram Swarath Rai and this petitioner

Patna High Court CR. MISC. No.59152 of 2022(3) dt.20-02-2023 2/3 caught hold of the husband of the informant and coaccused Kedar Rai assaulted him on his neck and above the eye by means of Tarchhebiya and fled away. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The specific accusation of assaulting to the husband of the informant is against Kedar Rai and the similarly situated coaccused has been granted bail by a coordinate Bench of this Court vide order dated 17.01.2023 passed in Cr. Misc. No. 65109 of 2022. The petitioner is languishing in custody since 22.07.2022.
