1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(2), 132, 324(4), 352, 351(2) and 3(5) of the BNS.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that Pramod Singh was asked to clear his electricity dues but he refused, as such, the electricity connection of his premise
Patna High Court CR. MISC. No.58934 of 2025(2) dt.10-09-2025 2/3 was disconnected. Thereafter, Pramod Singh, Ashok Singh, Santosh Singh, Subodh Singh, Shankar Singh along with other accused persons came and assaulted the informant and his team by helmet and sharp edged weapon on the back, neck and head causing injury.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that Pramod Singh was willing to clear the dues but the legitimate dues and not the fanciful demand being made by the informant and his side. It is next submitted that the electricity connection of the premise was disconnected only for the reason that fanciful demand of the informant was not met. It is also submitted that even presuming what has been alleged is true without admitting then no specific allegation of assault is alleged against the accused persons and the injury suffered by the injured is simple in nature. It is further submitted that the entire family members have been implicated in the instant case.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in
Patna High Court CR. MISC. No.58934 of 2025(2) dt.10-09-2025 3/3 the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Motihari Mufassil P.S. Case No. 185 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
