Petitioner is in custody since 07.06.2016 in connection with Sherghati P.S. Case No. 79 of 2016 registered under Sections 395 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner is not named in the F.I.R. and merely on the basis of extra judicial confession of Mantu Yadav @ Shatrudhan Yadav, name of this petitioner has surfaced in this case. Except confession statement, there is nothing against this petitioner and he has been in custody for the last eight months. Moreover, co-accused, Mantu Yadav @ Satrughan Yadav, Binod Yadav and Rahul Das, have already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 38756 of 2016 and Cr. Misc. No. 42054 of 2016 respectively.

No.1985 of 2017 (3) dt.17-03-2017 \ Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati (Gaya) in connection with Sherghati P.S. Case No. 79 of 2016.
