JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-01-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Shahpur P.S. Case No. 96 of 2016 registered for the offences punishable under Sections 323, 341, 504, 379, 307/34 of the Indian Penal Code.

The allegation against the petitioner is that he assaulted with iron rod to the informant on his head causing injury on his head and eye.

Submission is of false implication and that there is case and counter case, both sides have received injuries, the informant was at fist treated at Danapur Government Hospital and he was referred to P.M.C.H., Patna but he did not go to P.M.C.H., Patna as he felt better and to this extent the informant has given a written application vide annexure-3. The injury was caused to the

Learned APP submits that the injury has been caused on vital part.

In the facts and circumstances stated above, considering the annexure-3, the petitioner above named, in case of his surrender or arrest within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Shahpur P.S. Case No. 96 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
