2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected on 27.07.2023 in Cr. Misc. No. 18254 of 2023.

3. The petitioner seeks regular bail in the present case registered for the offence under Sections 302, 201, 34 of the Indian Penal Code.

4. As per the prosecution case, petitioner is the husband of the deceased. He is alleged to have killed the deceased.

5. Learned counsel for the petitioner submits that the charge has been framed in the case and no prosecution witness

Patna High Court CR. MISC. No.64233 of 2024(2) dt.01-10-2024 2/2 has been examined till date. Petitioner is in custody since 21.07.2022. Petitioner claims clean antecedent.

6. Learned A.P.P. has vehemently opposed the prayer for bail.

7. Considering the period of custody and also the fact that there is no progress in the trial, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge-II, Jehanabad/concerned Court below in connection with Rampur Chauram P.S. Case No. 26 of 2022 subject to condition that:- (i) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial.

(ii). Before accepting the bail-bond of the petitioner, the court below will verify the antecedent of the petitioner. If the petitioner is found having clean antecedent, then the bail-bond of the petitioner shall be accepted. If the petitioner is found having criminal antecedent(s), his bail-bond shall not be accepted by the court below.
